The Litigation Process in Arizona

Litigation is a lengthy process and can take as long as thirty to thirty-six months. Generally, depending on the Arizona County where the lawsuit is commenced, cases are subject to mandatory arbitration when the claim value is less than $50,000. Each side has a right to appeal the arbitration verdict and have a jury decide the case.

The person filing the lawsuit has the burden of proof, will have to pay the court expenses and process server fees and pay to have the doctors come in and provide testimony. It is strongly recommended that you do not try and attempt to represent yourself as there are strict court timelines and rules that must be followed or your claim risks being dismissed by the court.
